Wrongful Death While in Custody

About This Case

Kellsie Green was a young and beautiful young lady who was addicted to heroin. On January 5, 2016, Alaska State Troopers arrested Ms. Green and turned her over to the Anchorage Police Department where she was subsequently taken to jail in Anchorage.

Ms. Green was held at Anchorage jail from January 5, 2016, to the time of her death on January 10, 2016. On January 10, 2016, while still incarcerated at the Anchorage jail, correctional officers found Ms. Green unresponsive in her cell. CPR was performed and Ms. Green was transported to Alaska Regional Hospital where she was pronounced deceased at 10:38 a.m. The DOC failed and/or refused to provide Ms. Green with adequate medical care during obvious and serious withdrawal symptoms even when they knew of the life-threatening consequences withdrawal from heroin had on an individual.

Numerous depositions were taken of the personal at the DOC to include medical staff, the Corrections Officers as well as the Sergeants and Lieutenants that were present at the time Ms. Green was incarcerated.

Result

Our office was able to get a Judgment for Wrongful Death entered against the State of Alaska, Department of Corrections for the maximum amount allowed by law, $400,000.00, without having to go to Trial in this matter. This is the first time that this Judgement has been received without a Trial in the State of Alaska in regards to the Department of Corrections and a Wrongful Death suit.
